By placing an order for any of the goods or services from our website via a device, our mobile application or any other available channel, you agree to be bound by these terms & conditions
Section 1: Introduction of Farmcity
We are a brand of www.farmcityltd.com, unless otherwise stated.
Section 2: Definitions
2.3 “You” “Your” and “Yours” refer to you, the person accessing this website/mobile application, and placing the orders for the items we have displayed. Access through any other channel provided by Farmcity will also bound you to these Terms & Conditions.
2.4. “ We”,”Us”, “Our” and “Farmcity” are references to the Company.
2.5 Goods refers to any item which we may offer from our platform at any given time.
2.6 “Service” or “Services” refers to any service which we may supply or render and which you may request via our website or mobile app or our other platforms.
2.7 Food Delivery: This refers to perishable goods and any form of delivery service provided by us.
2.8 Website/Mobile application refers to our website www.farmcityltd.com, our mobile application or any platform we will choose to offer our goods or services.
SECTION 3: ORDERING
3.1 By placing an order through our website, mobile application and other platforms, you enter into an agreement with Farmcity with respect to the processing of the order. Farmcity remains responsible for the preparation, quality and delivery of your order(s). You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card details that you provide are yours and you have sufficient funds to make payment.
3.2 If you choose to pay with a debit or credit card, you confirm that you are the legal holder of the card and the funds in it. You also acknowledge that you have sufficient funds to make the payment.
3.3 Any meal which you might buy from our website, mobile application or our other platforms are intended for your use only. Resale of the meal or acting as an agent for a third party is forbidden under this agreement.
3.4 When ordering, you may be required to provide an email address and password. Please ensure to keep the combination of these details secure and do not disclose to a third party.
3.5 Any order placed on our platforms are subject to availability, delivery capacity and acceptance by us. Once an order is placed, we will send you an email to confirm that the order is been received and processed. While for unavailability of an item, we will let you know by text message (SMS) or phone call.
SECTION 4: PRICE & PAYMENTS
4.1 For Food delivery from our platforms, you agree to take particular care when providing us with your details and ensure that they are correct at the time of ordering.
4.2 All prices are in Nigerian Naira
4.3 All prices listed on our platforms are correct at the time of publication. However, we reserve the right to alter these in the future.
4.4 The total price for food, including delivery charges and other charges will be displayed when you place your order. Full payments are made online before an order is successfully placed.
SECTION 5: DELIVERY
5.1 Delivery periods at the time of ordering should be taken into account as approximate only and thus they might vary depending on the location. Goods will be sent to the delivery address you stated when placing the order.
5.2 In the case of delivery, we will ensure all items are delivered timely. However, our maximum delivery timeline is 2 hours depending on the location. Any delayed delivery will be the sole responsibility of Farmcity as this will warrant a refund to the customer if the order is cancelled due to delay beyond 2 hours.
5.3 If you fail to accept your meals at the time of delivery, or we are unable to deliver at the stated time due to your failure to provide appropriate instructions, or authorizations, then such items shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you. You will be charged in full for any storage, insurance and other costs which we incur as a result of the inability to deliver.
5.4 We are to deliver your meals to you at the stated address within the time confirmed to you. It is also our duty to inform you if we will be unable to meet up with the estimated timeline given to you.
SECTION 6: CANCELLATION
6.1 All Cancellations by you should be made before payment. No form of cancellation is allowed by the customer after payment is made is online except where the order is delayed beyond 2hrs. (See paragraph 5.2 above)
6.2 We may cancel an order if the product requested is not available for any reason. We will notify you if this is the case and return any payment that you have made.
6.3 For delivery of a wrong item, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the missing item. If we are only able to do a partial delivery (if a few items are not available) , we would inform you or propose a replacement to you.
6.4 You authorize us to use, store or otherwise process your personal information in order to provide the food delivery service, marketing and credit control purposes.
6.5 You are entitled to request a copy of the personal information we hold on you. Please contact us if you wish to request this information.
SECTION 7 : COMPLAINTS
7.1 We take complaints very seriously and place customers at the core of our processes. Please submit all complaints to the email address firstname.lastname@example.org
SECTION 8 : LIMITATION OF LIABILITY
8.1 We shall not be held liable for any failure or delay in our delivery services where such delays arises as a result of any act or omission which is outside our reasonable control such as all overwhelming and unpreventable events caused directly and exclusively by forces of nature that can be neither anticipated nor controlled nor prevented by the exercise of prudence, diligence and care, including but not limited to war, riot, civil commotion, compliance with any law or governmental order, rule, regulation , direction and acts of third parties.
8.2 We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.
8.3 In the event that Farmcity has a reasonable belief that there is an abuse of vouchers/discount codes, or suspected instances of fraud, we may have the customer blocked immediately and reserve the right to refuse future service.
8.4 Offers are subject to Farmcity’s discretion and may be withdrawn at any time without notice.
SECTION 9 : GENERAL
9.1 We may alter or vary the terms and conditions at any time without notice to you.
9.2 Do not use or launch any automated system or program in connection with our website, application or our online ordering functionalities.
9.3 Do not collect any personal identifiable information from the website, use communication systems provide by the website for any commercial solicitation purposes, publish or distribute any vouchers or codes in connection with the website or hack the website.
9.5 These T&C and our agreement shall be governed by and construed in accordance with then laws of Nigeria. Both we and you hereby submit to the non-exclusive jurisdiction of the Nigeria courts. All dealings, correspondences and contacts between us shall be made or conducted in the English language.
